Islamabad Readies Emergency Plan for 12 Khyber Pakhtunkhwa Districts, Sources Say; PTI Calls It a Breach of the 18th Amendment as March Halts in Mardan

October 10: Pakistan’s federal government has finalised preparations to impose an emergency in 12 districts of Khyber Pakhtunkhwa, The Express Tribune reported on Saturday, citing sources, as the Pakistan Tehreek-e-Insaf (PTI) long march led by Chief Minister Sohail Afridi stopped for the night in Mardan. PTI said such a step would be “a serious violation of the 18th Amendment”. No official announcement had been made by Saturday evening.

Why PTI cites the 18th Amendment

Article 232 of the Constitution lets the president proclaim an emergency when the security of Pakistan or any part of it is threatened by war, external aggression or “internal disturbance beyond the power of a Provincial Government to control”. The 18th Amendment of 2010 added two conditions. For an emergency based on internal disturbance, “a Resolution from the Provincial Assembly of that Province shall be required”. And if the president acts on his own, the proclamation must be placed before both houses of parliament “for approval by each House within ten days”.

The third column is our reading of the text, not a legal opinion. The sources quoted by The Express Tribune said the constitutional procedures for an emergency and for governor’s rule are distinct, so the final decision depends on which path is chosen.

PTI Khyber Pakhtunkhwa spokesman Shaukat Yousafzai said all stakeholders should be consulted first and that an emergency or governor’s rule “has never been a solution”. He said an all-parties conference had agreed a 15-point declaration, sent to the federal government, and welcomed mediation by Maulana Fazlur Rehman, The Express Tribune reported. PTI’s demands include easing restrictions on meetings with jailed founder Imran Khan, moving him to a hospital, hearings in his cases, and relief for his sisters and wife.

PTI also says more than 18 workers are missing, and reports have emerged of the arrest in Islamabad of MPA Fateh-ul-Mulk Nasir and MNA Dawar Kundi, The Express Tribune said. We could not independently verify these cases.

Where the march is

The march left Charsadda for Mardan on Saturday, and participants are spending the night there. Provincial Information Minister Shafi Jan said it was proceeding peacefully, The Express Tribune reported. Reports differ on the dates ahead: Dawn reported that Afridi called supporters to Swabi Interchange on October 11, while The Express Tribune said he asked workers to reach Swabi on October 12 and would announce next steps on October 13. What it means

The federal government appears to be preparing a legal tool that would take control of security and administration in 12 districts of the province’s south and former tribal belt without removing Afridi’s government outright. That would let Islamabad argue it is responding to militancy, not to the march, while sharply limiting the provincial government’s reach. But the 18th Amendment makes this hard to do quietly: without the provincial assembly’s consent, parliament must approve the emergency within ten days. If PTI follows through on mass resignations, the dispute would move from the roads of Khyber Pakhtunkhwa into a wider constitutional crisis.
